본 연구는 헌법기관인 법원에서 생산되는 법원기록물의 중요성에도 불구하고 제도, 시설, 인력 등 법원기록물 관리와 관련된 많은 부분에서 문제점을 가지고 있다는 점에 주목하여 법원기록물 관리와 관련된 법규 및 현황을 살펴보고 문제점을 분석하여 이에 대한 개선방안을 제안하는 것에 그 목적이 있다. 먼저 법원기록물이 생산되는 법원의 조직 및 조직별 수행 업무 분석을 통해 법원의 기능을 도출하고 기능별 법원기록물의 유형을 및 특징을 분석하였다. 그리고 법원기록물 관리 관련 법규를 바탕으로 유형별 법원기록물 관리 체계 및 법원기록보존소의 법원기록물 관리 현황에 대해 분석하여 기록관의 미설치, 통합된 법원기록물 관리 체계의 부재, 법원사자료 수집 법규의 중복 등 법원기록물 관리상의 문제점을 도출하였다. 이를 바탕으로 본 연구는 법원기록물의 특수성을 고려하여 다음과 같은 개선방안을 제안한다. 첫 번째, 권역별 기록관 및 법원기록관리위원회를 설치하고 법원기록보존소의 역할을 재조정하여 법원기록물 관리 기구를 개편해야 한다. 현재 법원에는 기록관이 설치되어 있지 않기 때문에 법원 각급기관 소속 처리과와 법원기록보존소에서 부담해야 하는 법원기록물의 양이 상당히 많다. 이에 효율적이고 전문적인 법원기록물 관리를 위해 고등법원이 설치되어 있는 서울, 부산, 대구, 대전, 광주 등 5개 권역에 권역별 기록관을 설치하여 각 권역별 고등법원과 그 관할구역 내의 각급법원 보존문서를 담당하도록 해야 한다. 또한, 법원기록관리위원회를 설치하고 법원행정처 소속의 법원기록보존소를 독립기구화하여 총체적인 법원기록물 관리를 위한 내실을 다져야 한다. 두 번째, 법원기록물 관리 관련 법규의 통합이 이루어져야 한다. 법원기록물은 법원이라는 동일한 생산 출처를 가짐에도 불구하고 법원기록물 유형별로 적용하는 법원기록물 관리 법규가 다르다. 이에 통합적이고 일원적인 법원기록물 관리를 위해 법원기록물 관리와 관련된 전반적인 사항을 규정한 새로운 「법원기록물 관리규칙」을 마련해야 한다. 세 번째, 법원사자료의 수집 체계를 개선해야 한다. 법원도서관의 법원사자료 수집 관련 법규를 개정하고, 법원도서관에서 수행하는 법원사자료 수집 관련 업무를 법원기록보존소로 모두 이관하여 기록물 수집 업무는 법원기록보존소에서 일괄적으로 수행하도록 해야 한다. 마지막으로 법원기록물 관리와 관련된 인프라 확충을 위해 「법원기록물 관리규칙」을 개정하여 기록물관리전문요원 배치 기준을 더욱 강화해야 한다. 이를 통해 전문인력을 충원하여 전문성을 달성해야 한다. 또한, 법원의 영구기록물관리기관인 법원기록보존소는 온전한 법원기록물 관리를 위한 「법원기록물 관리규칙」의 ‘영구기록물관리기관의 시설 및 장비 기준’을 모두 충족해야 한다.

This study focuses on the fact that despite the importance of the court records produced by the Constitutional Court, there are many problems related to the management of the court records such as institutions, facilities and manpower, The purpose of this paper is to review the laws and the status related to the management of the court records, analyze the problems, and suggest ways to improve them. First of all, the function of the court is analyzed through analysis of the organization and organization of the court records, and the types and characteristics of the records of the functions are analyzed. Based on the law related to the court records management, the court records management system and the court records management status of the Court Archives by type of court records were analyzed. As a result, problems in the management of court records have been raised. : There are no the Records Center, the absence of an integrated court records management system, collection law duplication of the historical materials of the Supreme Court. Based on this, this study suggests the following improvement plan considering the specificity of court records. First, we establish the regional records center and court records committee, We must reorganize the Court Records Management Organization by reorganize the role of the Court Archives. Since there is no Record Center in the court at present, there is a considerable amount of court records to be borne by the processing section of the courts and the Court Archives. In order to manage efficient and professional court records, we have installed records centers in five regions, namely Seoul, Busan, Daegu, Daejeon and Gwangju, and must be in charge of the High Court for each area and the court preservation documents at each level within the jurisdiction. In addition, establish a court records management committee, and should improve the overall court records management by making the Court Archives repository belonging to the court as an independent body. Second, integration of court records management regulations should be done. Although the court records have the same source of production as the courts, the court records management laws apply different types of court records. In order to manage the integrated and unified court records, a new "court records management regulation" should be prepared that outlines overall matters related to court records management. Third, we should improve the collection system of the historical materials of the Supreme Court. It is necessary to amend the laws related to the collection of the historical materials of the Supreme Court of the court library and to transfer the matters related to the collection of the historical materials of the Supreme Court to the Court Archives so that the collection of records is performed collectively at the Court Archives. Finally, in order to expand the infrastructure related to the management of the court records, through amending the "Court Records Management Regulation" to achieve professionalism by recruiting experts, Records management facilities and equipment must be equipped for complete court records management.
